domains: building & contracting law

This legal domain concerns the general contracting law with specific emphasis on private building law.

Known problems in private building law are among others the liabilities of the various parties concerned in the building process, such as contractor, architect, building promoter, …

The office is regularly contacted by private parties who are not satisfied with the building works done, for example because of poor performances, exceeding the agreed building time and the like.

The office is further contacted by professionals, such as contractors, architects and building promoters whose liability is addressed by their principals.

In addition to this, the office also provides legal assistance within the framework of expert investigations in building matters.  Indeed, claims regarding the liability of for example contractor and architect often involve the appointment of an expert (experts) in order to determine and examine the asserted defects.  The said expert will among others draw up a report with a description of the defects, the causes thereof, the technical liabilities, any repair works and the cost thereof.  This report will be used before the court to judge the liability and to grant compensations, if any.

The private building law also concerns contractual aspects, such as advice and drawing up of agreements with contractors, architects and building promoters.

The office is also regularly confronted with questions regarding neighbourhood disturbance and damage due to building activities and buildings, and of course matters of property law, such as property, co-property, usufruct, building and planting rights, long leases and servitudes.

The legal assistance provided by the office includes both giving advice, as well as providing assistance before the legal authorities.

The office will act on behalf of private persons and of professionals.
